Is this even possible ? . If Trump wins on election day, the electoral votes still have to be counted in the states on December 8, 2024 and then certified by the Congress on January 6, 2025. A new Congress (the one elected on November 5, 2024) will be sworn in on January 3, 2025. Sometime on January 4 or 5, 2025 they will pass a resolution saying that Trump is an “insurrectionist.” Under Section 3 of the 14th Amendment, that means Trump is not eligible to hold federal office. Biden will not have 270 electoral votes and Trump’s votes won’t be counted. That means nobody wins. The election of the president is then thrown to the House of Representatives and a majority of the state delegations (with one vote state) can elect a president. This could be Nikki Haley or Gavin Newsom. Something like this did happen in 1800 and again in 1824. The Democrats won’t quit trying to destroy Trump so don’t rule anything out.
